Cuando al tiempo de cometer el hecho se hallare el agente en estado de enajenación mental o de intoxicación crónica producida por el alcohol o por cualquiera otra substancia o padeciere de grave anomalía psíquica, se aplicarán medidas de seguridad en vez de penas militares.
