El que no adopte todas las medidas militares necesarias o no reclame los auxilios que le son indispensables, estando en peligro de ser atacado, incurre en. Prisión de uno a cinco años.

Si por consecuencia del hecho anterior resultan perjuicios para las armas de la República, la pena es de dos a diez años de presidio.
