Si el Congreso no alcanzare á legislar sobre la materia, queda facultado el Gobierno para fijar la división militar del territorio y organizar las milicias de acuerdo con la legislación vigente y las prácticas usuales de las naciones civilizadas sobre la materia, y sus disposiciones regirán hasta que resuelva lo contrario el próximo Congreso.
