Si se trata de una decisión de la Corte Plena, se debe proceder al sorteo del Conjuez o Conjueces necesarios para constituir la mayoría.

El Magistrado o Conjuez disidente debe salvar su voto, expresando las razones de éste, para que no le toque parte alguna en la responsabilidad que pueda aparejar lo resuelto por la mayoría.

Los votos salvados no aparejan responsabilidad.
