Art.8.° Si al tiempo de practicar el congreso el escrutinio de los votos dados para majistrados de la suprema corte federal, se tuviere conocimiento por la mayoria de los miembros del congreso, o por algún documento oficial auténtico, que ha muerto alguno de los individuos favorecidos con votos suficientes para declararlo nombrado magistrado principal, se tendrán los votos dados a su favor como no emitidos, prescindiendo de ellos absolutamente.
