Artículo noveno. Cuando se compruebe que el empresario está empleando los elementos introducidos al amparo de las previsiones de este Decreto en fines distintos para los que fueren importados, se harán efectivas las garantías constituidas, sin perjuicio de la acción penal aduanera por la introducción ilegal de mercancías.
