Respecto a la responsabilidad de los integrantes de las FARC- EP se tendrá en cuenta como referente jurídico el Derecho Internacional Humanitario, el Derecho Internacional de los Derechos Humanos y el Derecho Internacional Penal, y el Código Penal colombiano, siempre con aplicación de la norma más favorable. La JEP tendrá en cuenta la relevancia de las decisiones tomadas por la anterior organización que sean pertinentes para analizar las responsabilidades.
