No pueden desistir de la instancia o abandonar la acción:

1ºLos Agentes del Ministerio Público en los asuntos en que intervienen en representación de la Nación, los Departamentos o los Municipios, sino en los casos autorizados expresamente por las respectivas entidades;

2º Los curadores ad litem, salvo que para ello los autorice el Juez, quien debe conceder esta autorización con conocimiento de causa; y

3º Los apoderados oficiales, cuando para ello no están expresamente autorizados por sus poderdantes.
