Cuando sea rematada una finca para el pago de la parte exigible de una deuda a plazos para cuya seguridad haya sido aquélla hipotecada, el ejecutado no puede percibir el sobrante del precio del remate, deducida la parte exigible de la deuda, sin asegurar, a satisfacción del acreedor, la cantidad que quedare a deber, la cual se deposita mientras tanto en un establecimiento de crédito autorizado.
