Si la caución consiste en dinero o prenda, el Juez hace el depósito en poder de un secuestre.

Si consiste en una fianza, ésta se puede prestar en el mismo expediente, o en escritura pública, de la cual se agrega a ésta una copia registrada.

Cuando se trate de una hipoteca, se debe agregar al proceso la copia registrada y anotada de la escritura correspondiente.
