No podrá condenarse en costas en las sentencias definitivas de segunda instancia cuando la del inferior sea confirmada por razones distintas de las alegadas en ella.

Tampoco habrá condenación en costas en el caso del último inciso del Articulo 12 de la Ley 90 de 1920 .
