Cumplidas las anteriores formalidades, el Presidente declarará ausente a quienes figuren en la resolución de acusación cuya comparecencia no se haya obtenido, y si tampoco comparece el Defensor que ha venido actuando, hará los respectivos nombramientos de Defensores de Oficio, les dará posesión y con ellos se continuará el juicio.
