Recibido el expediente por el competente si éste considera que efectivamente aparece que el hecho investigado no ha existido, que la ley no lo considera como falta disciplinaria o que el funcionario acusado no lo cometió, o que hay lugar a exoneración de responsabilidad y por lo tanto no encontrare mérito para sancionar, procederá a ordenar el archivo del expediente.
