En caso de que un empleado u obrero de los que trata el artículo 1° de esta Ley quedare incapacitado definitivamente por accidente de trabajo o enfermedad contraída en ejercicio de su oficio o profesión, tendrá derecho a la jubilación sea cualquiera el tiempo de servicio que haya prestado el establecimiento y le edad que tuviere.
