Al aplicar las disposiciones de los incisos 1° y 2° del artículo anterior, no se tendrán en cuenta las contravenciones, los delitos culposos, los delitos contra la disciplina militar, los delitos políticos cometidos sin homicidio, incendio, saqueo o robo, el homicidio y las heridas cuando haya mediado provocación o haya habido exceso en la defensa o en el estado de necesidad, y los delitos cometidos por menores de diez y ocho años.
