°. Información en procesos penales . Cuando existan denuncias penales formuladas por obligaciones frente a las cuales se haya hecho uso del orden transitorio de imputación de pago, inmediatamente se hayan pagado los impuestos, anticipos, retenciones a que haya lugar, el funcionario a cargo de la actuación dará aviso al fiscal o juez penal correspondiente para que proceda de conformidad con lo previsto en el inciso final del

Parágrafo transitorio

del artículo 804 del Estatuto Tributario. Este aviso igualmente podrá ser comunicado por el interesado, acreditando los pagos respectivos.
