Clasificación

Para efectos de su remuneración, los Defensores Públicos del Sistema podrán clasificarse en tres (3) categorías:

Defensores Públicos ante jueces penales municipales.

Defensores Públicos ante jueces penales del circuito y del circuito especializado.

Defensores Públicos ante las Salas Penales de los Tribunales Superiores de Distrito Judicial y de la Corte Suprema de Justicia.

Parágrafo

En caso de requerirse la sustentación de un recurso ante un funcionario superior, el defensor público deberá actuar sin que ello signifique cambiar de categoría.
