La nueva pensión reajustada conforme a lo dispuesto en los artículos anteriores, no podrá exceder el monto de la pensión máxima fijada por la ley en ese momento. Con todo, la elevación del tope máximo de las pensiones afectará a aquellas que estén en vigor, de tal manera que siempre exista la posibilidad de aumento hasta el máximo legal, dentro del porcentaje ordinario que corresponda a la respectiva pensión. Ninguna pensión mensual podrá ser inferior a las nueve décimas partes (9/10) del mayor salario mínimo vigente en el país.
