Cuando la nulidad decretada por sentencia judicial ejecutoriada a que se refiere el artículo 129 de este Código fuere de escrutinios o declaratoria de elección, no habrá lugar a convocatoria de nuevas elecciones y se dará aplicación al artículo 247 del Código Contencioso Administrativo practicando nuevos escrutinios sobre el total de los votos que no hubieren sido invalidados en la sentencia respectiva.
