ARTICULO 2.1.3.2.28 .- SANCIONES. La administradora que no traslade efectivamente los recursos equivalentes al defecto estará sujeta a una multa a favor del Tesoro Nacional hasta por un monto igual a diez (10) veces el valor del mismo, la cual será impuesta por la Superintendencia Bancaria. Lo anterior sin perjuicio de las acciones que tendrá el Fondo de Garantías de Instituciones Financieras para repetir lo pagado. Para el efecto, prestará mérito ejecutivo la certificación que expida la Superintendencia Bancaria. Podrá ser objeto de toma de posesión de una administradora el incumplimiento de la obligación de hacer efectiva la rentabilidad mínima en los plazos previstos en el artículo 2.1.3.2.27. del presente estatuto.
