- REGIMEN SALARIAL Y PRESTACIONAL DE LOS EMPLEADOS PUBLICOS TERRITORIALES. Corresponde al Congreso hacer las leyes. Por medio de ellas ejerce las siguientes funciones: Dictar las normas generales, y señalar en ellas los objetivos y criterios a los cuales debe sujetarse el Gobierno para los siguientes efectos

Fijar el régimen salarial y prestacional de los empleados públicos, de los miembros del Congreso Nacional y de la Fuerza Pública;

Regular el régimen de prestaciones sociales mínimas de los trabajadores oficiales; Estas funciones en lo pertinente a prestaciones sociales son indelegables en las Corporaciones públicas territoriales y estas no podrán arrogárselas (Constitución Política, art. 150., nral. 19. lit. e y f).
