Cuando se admite el recurso y se conceda la apelación en el efecto suspensivo, se dispondrá en la misma resolución que el inferior suspenda todo procedimiento y envíe originales los autos.

Si el recurso se concede sólo en el efecto devolutivo, se dispondrá que se envíen las diligencias al inferior, para que proceda como si él lo hubiera concedido; pero si por las copias presentadas por el recurrente de hecho, pudiere decidirse la apelación se decidirá siguiendo las reglas generales.
