Decisión. Vencido el trámite ante rior, si no hubiere habido declaratoria de deserción, el Superior resolverá dentro de los tres días siguientes. Si concediere el recurso de apelación, determinará en que efecto y solicitará el expediente original. Si lo estima bien negado, así lo declarará y enviará la actuación al inferior para que forme parte del expediente.
