Siempre que se cree un nuevo municipio se tendrá por creado el correspondiente juzgado municipal, con el carácter de promiscuo y con el personal y asignaciones que la ley señala a tales juzgados. En tal virtud, el Gobierno Nacional procederá de inmediato a hacer las operaciones presupuestales necesarias para atender a los gastos que ocasione el funcionamiento del nuevo juzgado y dará aviso al respectivo tribunal superior para la elección del juez.
