Excepción al deber de declarar. Na die podrá ser obligado en asunto criminal, correccio nal o de policía, a declarar contra si mismo, con tra su cónyuge o contra sus parientes dentro del cuarto grado civil de consanguinidad, segundo de afinidad o primero civil. Este derecho se le hará conocer por el funcionario respectivo a toda persona que; como procesado o testigo, vaya a declarar.
