ARTICULO 142 . Actuación y desplazamiento del defensor. El defensor designado por el sindicado podrá actuar a partir del momento en que presente el respectivo poder, y desplazará al defensor que estuviere actuando. Solo por estar irregularmente conferido, el funcionario judicial podrá rechazar el poder dentro de los tres días siguientes a su presentación. En caso de ser rechazado, el defensor que fue desplazado recobrará la legitimación para actuar. En todo caso quien haya tenido acceso al expediente está obligado a guardar la reserva debida.
