El Tribunal Superior Militar estará dividido en Salas, cada una de las cuales se integrará por tres Magistrados Abogados y con el Comandante General de las Fuerzas Armadas, que debe presidirlas. Las decisiones se tomarán por mayoría de votos y en casos de empate, este se decidirá por la intervención de un Magistrado de las otras Salas escogido a la suerte. En la misma forma se debe proceder cuando un Magistrado se declare impedido o cuando prospere una recusación.
