Art. 5.° Para los efectos del artículo anterior se tendrá por residencia el lugar en que el individuo electo se halle establecido i en que tenga su morada habitual i ordinaria.
En caso en que se declare i comunique la eleccion de un individuo a tiempo de hallarse ausente de su residencia habitual i ordinaria, se le pagará el viático desde ésta, i no desde el lugar en que se encuentre temporal o transitoriamente.
