Son funcionarios auxiliares de la Justicia Penal Militar:

1° Los funcionarios de instrucción;

2° Los Fiscales;

3° Los Comandantes de unidad operativa, Fuerza Aérea y Armada Nacional, y

4° El Comandante Superior de las Fuerzas Militares y, en su defecto el Jefe del Estado Mayor General.
