Silencio administrativo. Si transcurre el término previsto en el primer inciso del artículo 26 sin que se expida y notifique el acto que decida de fondo el recursos de reposición, se entenderá fallado a favor del recurrente, en cuyo caso la Dirección de Impuestos y Aduanas Nacionales así lo declarará a de oficio o a petición de parte.
