Según fue establecido en la Ley 1097 de 2006 , las erogaciones que se ejecuten con cargo a gastos reservados que de conformidad con el concepto del ordenador del gasto no puedan ser ejecutadas por los canales ordinarios, no se sujetarán a las normas y procedimientos previstos en el Estatuto de Contratación Estatal. Dichas erogaciones se someterán al procedimiento especial creado a través de esta ley.
