LEGISLACIÓN ANTERIOR

Art. 9.° La facultad concedida á los Ejércitos del Gobierno por el artículo 1.° del Decreto de carácter legislativo de 14 de Enero de 1901, se limitará á los casos urgentes en que imprescindibles necesidades de la guerra obliguen á hacer uso de dicha facultad, y en este caso, los bienes de los enemigos se tomarán ú ocuparán con intervención de la respectiva autoridad civil, siempre que sea posible la presencia de ésta; pero sin causar más daño que el que fuere inevitable, y expidiendo á favor de los propietarios el correspondiente recibo, previo el avalúo y demás formalidades, para que puedan hacer uso de sus derechos.
