La afectación a que se refiere el artículo anterior opera por ministerio de la ley respecto a las viviendas que se adquieran con posterioridad a la vigencia de la presente ley.
Los inmuebles adquiridos antes de la vigencia de la presente ley podrán afectarse a vivienda familiar mediante escritura pública otorgada por ambos cónyuges, o conforme al procedimiento notarial o judicial establecido en la presente ley.
