Para que los herederos comparezcan a hacer relación de bienes y deudas, el Juez los obligará con apremios legales.

Los legatarios son parte en el juicio de sucesión para obtener la efectividad de sus legados. En tal virtud, tendrán derecho para demandar la apertura de la sucesión, intervenir en las diligencias de inventarios y avalúos, pedir la partición de los bienes y objetar ésta, cuando no se les reconozca sus derechos.
