Este recurso puede ser interpuesto:

Por el agente del Ministerio Público, bien sea el Fiscal del Tribunal respectivo, o por el Procurador General de la Nación;

Por el reo o sindicado personalmente, o por medio de su representante legal, su defensor o apoderado constituido para el recurso.
