° Se considerarán incluidos en el seguro de las mercaderías de los fletes i los gastos durante el viaje, solo cuando se haya estipulado así espresamente: en este caso el asegurador no estará obligado al pago de aquella porcion de flete o gastos que por causa de siniestro ocurrido en el transito no llegaren a deberse; i devolverá la mitad de la prima que corresponda a dicha porcion.
