Cuando por haber fallecido un testigo que ha declarado en información sumaria en otro juicio, no sea posible obtener su ratificación, la parte interesada puede pedir que, con citación de la contraria, declaren testigos abonados acerca de la veracidad y buena fama del fallecido. Previo este abono, se tiene la declaración como legalmente ratificada.
