Art. 29. La caducidad de la instancia impuesta como pena al actor que abandona el juicio , en los términos del Artículo 54 de la Ley 105 de 1890 , no se aplicara á los juicios de sucesión y de participación de bienes comunes, y en general á los que se siguen con simple jurisdicción voluntaria, ni á los ejecutivos. Respecto á estos últimos, la disposición es aplicable desde que se hayan embargado bienes.
