Articulo 45. De cuando se declara desierto el concurso y de su efecto. Cuando el concurso se declara desierto conforme a lo establecido en el artículo 16 del Decreto 694 de 1975, el organismo o entidad deberá proceder a una nueva convocatoria y selección. Si las necesidades del servicio lo imponen se podrá proveer el empleo en forma provisional hasta por un término de seis (6) meses, período dentro del cual deberá realizarse el nuevo concurso.
