Artículo octavo. Es función del Consejo de la Orden establecer y comprobar los requisitos para proponer el otorgamiento de la Orden del Mérito Penitenciario en sus diferentes categorías, aprobar u objetar su concesión y suspender el derecho al uso de sus insignias por actos incompatibles con la dignidad de aquella, en votación secreta.
