De la solicitud del padre o de la madre de familia para que se le conceda licencia de emancipar a un hijo, se le corre traslado a éste y al Ministerio Público por dos días a cada uno.

La solicitud puede ser hecha de una vez por el padre o la madre y el hijo, caso en el cual no se da traslado sino al Fiscal.

Si el Ministerio Público no se opone y el hijo consiente, el Juez falla sobre las pruebas presentadas.

Si el Ministerio Público se opone, se abre el juicio a prueba por diez días, vencido el cual se resuelve por el Juez dentro de los cinco días siguientes.
