Para que pueda otorgarse el término extraordinario se requiere:

Que se solicite dentro de los diez días siguientes al en que se notifique el auto de apertura a prueba.

Que los hechos que se quieran probar hayan ocurrido en el país donde se intente practicar la prueba, o que allí se hallen las personas que sobre tales hechos deban declarar.

Que se indique la residencia de tales personas; y

Que se expresen los archivos donde se hallen los documentos que hayan de copiarse y sean éstos conducentes.
