De acuerdo con lo previsto en el artículo 44 del Decreto 1900 de 1973, lo dispuesto en el artículo 40 del mismo Decreto, en cuanto la restricción de la inversión extranjera en explotaciones forestales, no tendrá lugar cuando dicha inversión se haga en las empresas que se hayan constituido o se constituyan para la explotación de áreas nuevas.
