Cada parte puede tachar a los testigos de la otra alegando los hechos que constituyen la tacha, según los artículos anteriores y probándolos oportunamente.

El Juez puede declarar, aún de oficio, las tachas comprobadas no provenientes de parcialidad, pues las de esta clase sólo son alegables por el litigante contra el cual se presume que el testigo tiene interés en declarar.
