º. Justificación de la inexplotación. No habrá lugar a las declaratorias de extinción del dominio previstas en el artículo anterior, cuando las causales obedezcan a hechos constitutivos de fuerza mayor o caso fortuito, según lo previsto en la Ley 95 de 1890.
