Para otorgar la gracia de que trata la Ley número 4 de 1908, el carácter militar que tenía el sindicado cuando cometió el delito deberá aparecer bien comprobado en el proceso por medio de cualesquiera de las pruebas que reconoce el Código Judicial, y las cuales podrán aducirse en cualquier tiempo por el sindicado ó condenado.
