Desde que se presente la petición de recusación, o desde que se manifieste impedido el juez o magistrado, hasta que se resuelva definitivamente, se suspenderá el proceso, si estuviere en estado de juicio; pero si fuere sumario, podrán ejecutarse los actos urgentes de instrucción.
