Art.5. º Para que, que llegado el caso del artículo anterior pueda el Poder Ejecutivo llenar sus deberes constitucionales, es obligacion de los Estados, conforme al artículo 26 de la Constitucion, i a los artículos 1,º 3 ,º 25, 27 i 40 del decreto orgánico del Ejecutivo de 2 de diciembre de 1862, organizar la milicia nacional.
