Quedan prohibidos:

Los negocios fiduciarios secretos;

Aquellos en los cuales el beneficio se concede a diversas personas sucesivamente, y

Aquellos cuya duración sea mayor de veinte años. En caso de que exceda tal término, sólo será válido hasta dicho límite. Se exceptúan los fideicomisos constituidos en favor de incapaces y entidades de beneficencia pública o utilidad común.
