Se recibirá declaración indagatoria al que en virtud de antecedentes y circunstancias consignadas en el proceso, o por haber sido cogido in flagranti delito, considere el funcionario autor de la infracción penal o participe en ella.

Esta diligencia se llevará a efecto dentro de las veinticuatro horas siguientes a aquella en que se hubiere verificado la captura o comparecencia del procesado.
